_‘ One of the pleasures of this holiday season is to thank many people for their friendship, goodwill and the pleasant association I have enjoyed with the hundreds of friends and professional people I have dealt with over the past thirty years. We sincerely appreciate our relationships and are thankful for the confidence many people have shown in us. I again want to take the time to extend to these friends our sincere gratitude because it is friends and new clients that make our business grow. Client recommendation is a very important source of new clients to us.

In the true spirit of the Holiday and Christmas season, may we all be thankful and share in the hope for goodwill toward all.

_{Vercammen Family 2025 update:}_{My wife Cynthia & I have enjoyed traveling since she retired from teaching. We love our home in Neptune across from the Shark River and the bike rides to the beach. Cynthia swims a mile every day and Ken runs the 5k races every weekend.}

_{My daughter Shannon and husband Zach Gildenberg are busy with our grandson Logan John born in 2023. Cynthia is the handling Grandma duties each week. Logan & I ran the Lollipop races in the summer and catching sand crabs. Clients enjoyShannon’s Daisy Dog often visiting the Law office.}

_{My son Dr. Brendan the dentist is getting married to Dr. Morgan on March 21 at Caledonia Golf course in South Carolina. They love life and & boating in Myrtle Beach. My Dad Al celebrated his 93rd birthday with many friends in Jackson NJ. My sister Janet joined my Dad in Jackson and family & her friends will be at her birthday party in February.}

_{Lunch & Learn}_{Past clients are invited join us at the "Update -}_{Wills and Estate Planning}_{” Seminar on January 8, 2026 from 12:15-12:55 pm in our Law Office. Sandwiches provided. Many individuals have not taken the time to have a Will or Power of Attorney prepared or have not updated in decades.}

_{We handle more Wills, Estate Planning & Probate, Estate Administration and contested Will cases. The Law Office has become more efficient in preparing Wills and POA. Clients now simply type the interview form and email to the office so they don’t need to take off from work or travel. We now can prepare Wills online without clients having to come to the office!}

_{The Law Office also handles Municipal Court cases via Zoom or online without having to take a day off to go to court.}

_{We can often fight for clients with DWI to have no suspension or only a short license suspension in NJ}

_{For first offender DWI, for decades there was no way to avoid a license suspension of 6 months of more.}

_{Under a revised NJ DWI law, sometimes we can help clients by limiting the loss of license for only a few days.}

_{Your attorney can file Motions to challenge the DWI alcotest machine. Some clients can apply for an interlock machine on the car they operate instead of the lengthy license suspension.}

State v Blackham

In this DWI case, the state relied on the community caretaking doctrine to justify the police's encounter with the defendant and his parked motor vehicle. The Appellate Division reversed the defendant’s conviction, concluding that the municipal court and the Law Division legally erred in finding the elements of community caretaking were met. The State cannot salvage the validity of the motor vehicle stop by now invoking a different exception to the warrant requirement. unreported

The Supreme Court held that Under the totality of the circumstances in this case, the police acted in an objectively reasonable manner to meet an exigency that did not permit time to secure a warrant. No bright-line rule governs the question of exigency, and determining whether the exigency exception to the warrant requirement applies requires courts to conduct an objective, fact-sensitive analysis. Drawing de novo legal conclusions from the facts found by the trial judge, the Court finds that here, time was of the essence, delay was not reasonable, and seizure of the DVR by the police without a warrant was justified by exigent circumstances.
