We now recommend a new Power of Attorney be signed every 5 years because banks and financial advisors give persons a difficult time with old documents.

3 Issues with Co-Ownership of Bank Accounts

Another common mistake is when people have one child helping them manage all of their finances, so they add that child as a co-owner to their bank account. They have no gifted him or her one-half the value of that account. Currently, you can gift up to $17,000 per year, per beneficiary, without having to file a gift tax return. If half of the value is greater than 17,000 then you are legally required to file a gift tax return. If the child gets into creditor issues, gets divorced, or sued, half of the account may then be subject to the claims of his or her creditors. 


         Upon the parent’s death, the child will rarely share the account funds with siblings. Further, that child has no legal obligation to use the funds to pay for the parent’s final expenses. He or she will receive that money and want to keep it, even if sharing it was the intention of the donor. Beneficiary designations have a role to play in estate planning, but they are not well used by themselves, as they’re a very simplistic form of estate planning. It’s much better to incorporate the use of beneficiary designations into a more comprehensive and sophisticated type of planning


5 Keeping Your Estate Plan Up-To-Date

  While creating your estate plan, one of the first questions we ask is whether you already have a plan in place. A Will from 1987 is not going to do you much good because everything has changed since then. It’s very important that you update your plan. An estate plan is not something that you want to put in place and then never look at again because life circumstances will change. It is important that at least every two to three, you review your estate plan with your attorney if there have been no major life events during that time. Have you purchases new real estate? Have you opened new accounts? Is everything still properly titled in the name of the trust, so that we can continue to avoid probate?


         Maybe a child has been divorced or you have new grandchildren; maybe we want to set aside some money for the college education of those grandchildren. Certainly, upon the death of a spouse, it’s essential that you review your estate plan. If you’ve made a plan with your spouse and you’ve named the spouse as your agent for healthcare, it can waste valuable time in emergency. Updating things as simple as who your agent is for healthcare can result in much more efficient and safe process in finding your healthcare agent. People will often think if there has been no significant change in the law, they don’t need to change anything, but you’ve got to look at the changes within your family.
