1    Story of Memorial Day 

  Memorial Day is a federal holiday in the United States for remembering the people who died while serving in the country's armed forces  

Memorial Day is not to be confused with Veterans Day; Memorial Day is a day of remembering the men and women who died while serving, while Veterans Day celebrates the service of all U.S. military veterans.

  Memorial Day is a solemn day of mourning, a sacred day of remembrance to honor those who paid the ultimate price for our freedoms. We need to remember with sincere respect those who paid the price for our freedoms; we need to keep in sacred remembrance those who died serving their country. We need to never let them be forgotten.  On Memorial Day we need to stop and pay with sincere conviction our respects for those who died protecting and preserving the freedoms we enjoy, for we owe those honored dead more than we can ever repay.

S.A.L. Membership Eligibility Requirements

All male descendants, adopted sons and stepsons of members of the American Legion, and such male descendants of veterans shall be eligible for Membership in the Sons of The American Legion.  Ken Vercammen is a member of the Sons of American Legion in Edison.

3 Recent cases   Motion to vacate old  Domestic Violence restraint FRO denied where no change in circumstance E.J. v. M.W.

  Defendant appealed the denial of his motion to dissolve a 2013 FRO entered in favor of his grandmother. Thirty-one year old plaintiff had history of head injuries beginning as an infant and cognitive, behavioral and mental health difficulties since childhood. In 2013, trial court found defendant committed the predicate act of harassment in a letter he wrote to grandmother and in many phone calls and text messages. Trial court found the purpose of the letter and messages was to "annoy" and "harass" and grandmother had seen defendant become angry and punch walls. Defendant sought to dissolve the FRO under N.J.S.A. 2C:25-29(d). Trial court questioned grandmother over the phone because she was restricted to a nursing home due to her advanced age and health issues. Grandmother provided confusing and contradictory answers to the court.     

          Trial court reviewed the record and found the FRO was properly issued based on credible evidence. Defendant gave conflicting testimony as to whether he had violated the FRO and said he wanted the FRO dissolved because it said he was bipolar. Trial court made findings under the factors in Carfagno v. Carfagno, 288 N.J. Super. 424, and found the FRO should remain in effect. Court found trial court did not abuse its discretion and defendant failed to show changed circumstances. A-2228-21Unreported Source Daily Briefing  2023-06-06


  4 Double Jeopardy barred prosecution in Superior Court after plea in Municipal Court  State v. Geddes

  Defendant appealed trial court's denial of his motion to dismiss a Camden County indictment following a guilty plea to theft in a Gloucester County municipal court arising from the same forgery and check cashing scheme. After defendant was indicted by a Camden County grand jury for third-degree conspiracy to commit theft by deception, third-degree theft by deception and third-degree uttering a forged instrument, he pled guilty pro se to theft by unlawful taking in Gloucester County municipal court. Then, represented by counsel, defendant moved to dismiss the Camden County indictment. Trial court denied the motion. Defendant pled guilty to third-degree conspiracy to commit theft by deception and appealed, arguing he was placed in double jeopardy because he was prosecuted twice for the same crime. Court reversed. Defendant was charged in both counties with conspiracy to commit theft by deception. He pled guilty in one county to the downgraded charge of theft by unlawful taking. The statutes defining those crimes overlapped but did not have, in total, the same elements. Thus double jeopardy did not apply under the constitutional "same-elements" test. 

        Under state law, however, a subsequent prosecution for the same conduct is barred if the statutory offenses at issue are meant to prevent substantially similar harms. That was the case here. It was inescapable that defendant's theft plea and his later guilty plea for conspiracy to commit theft by deception arose from the same illegal activity. The pertinent criminal statutes, further, were intended to prevent substantially similar harms, namely the taking of another person's property. Thus court held defendant's subsequent conviction in Camden County based on the same criminal act to which he pled guilty in Gloucester County municipal court was contrary to principles of fairness and had to be reversed. Court reversed trial court's denial of defendant's motion to dismiss the Camden indictment and vacated defendant's associated sentence. A-2350-20 Unreported Source Daily Briefing  2023-06-12

  Justice Albin retired as a former Associate Justice of the New Jersey Supreme Court where he served for twenty years,

New Jersey Supreme Court Justice Albin has been called “the consummate jurist” and “a constitutional giant.” He authored more than 400 opinions, including more than 230 majority opinions, more than 130 dissents, and dozens of concurrences on issues spanning the wide spectrum of the law. He has written on such topics as civil rights, criminal law, insurance, employment discrimination, contracts, taxes, municipal government, elections, products liability, and mass toxic torts. 

Justice Albin is the author of landmark opinions on the rights of same-sex couples, the rights of the accused and workers, and civil rights, among others. He also authored a number of dissents, which later became law.
