1. Criminal Court Orders Rule Relaxation For Pretrial Service Documents
Effective on 1/1/17, Rule 1:38-3 will be relaxed and supplemented to permit the release of certain court records pertaining to the Pretrial Services Program to attorneys of record or to the public. The rule outlines court records to be excluded from public access, but with the rollout of the criminal justice reform, courts will be permitted to release the following:
To attorneys of record:
Certain records, such as motions or exhibits and the results of any risk assessment instrument for the purposes of determining, setting, or modifying conditions of release, determining violations of conditions of release, determining whether pretrial detention is appropriate and sentencing of a defendant;
Recommendations of release provided by the Pretrial Services Program.
To the public:
Records pertaining to conditions of pretrial release or pretrial detention;
Records such as motions or exhibits and the results of any risk assessment instrument that are otherwise obtainable under the court rules.
The Court's Criminal Practice and Municipal Court Practice committees are expected to develop and adopt appropriate amendments to Rule 1:38-3, subject to subsequent review and recommendation by the Advisory Committee on Public Access to Court Records. This order will remain in effect until such amendments are adopted.
2. Supreme Court Orders Relaxation Of Rules Regarding Juveniles Waived To Adult Status
The Supreme Court issued an order relaxing and supplementing a number of rules to accommodate pretrial release procedures for juveniles waived to adult status in anticipation of the Criminal Justice Reform roll out, which began Jan. 1.

  The NJ statute on expungement was revised effective April 18, 2016.  If someone has been arrested or even had a private criminal complaint signed against them in the Municipal Court, they have a criminal record, even if the charges were dismissed or received a Conditional Discharge Under NJ Law past criminal arrests and convictions can be expunged/ erased under certain instances. This program will discuss the expungement process. I served as a Municipal Prosecutor and was amazed how minor criminal guilty pleas and even dismissed charges can affect someone’s ability to get a job or advance a career. Do you have children or someone you know or work with that needs an expungement?

     More info: The Petition for expungement is filed in the Superior Court. It takes a minimum of three months for the court to grant the expungement. The requirements are very formal. There can be a waiting period between 6 months up to 10 years after the criminal case is finished. For someone who had a drug charge, they can hire an attorney apply for Expungement 6 months after the Conditional Discharge is complete. The statute requires detailed notices served by the attorney on the State Police, Attorney General and numerous other government entities.
         Typical Court costs and Legal fees for expungement range from $1,500-$2,500.
