1. Ken Vercammen of Edison has been appointed Chair of the ABA Estate & Financial Planning Committeeof the ABA Solo Division for the 2020-2021 year by ABA Division Chair Alfreda Coward. Ken will be organizing meetings for the ABA Ft. Lauderdale Solo Summit in October and the April 2021 San Juan meeting rescheduled from April 2020.
 The ABA Solo Division has over 16,000 members. Kenneth Vercammen is the author of the ABA book "Wills and Estate Administration"
 
2. Fighting a DWI under the influence of prescription medication or drugs
         The NJ DWI law was changed for persons under influence of alcohol effective December 1, 2019. With the installation of an alcohol detecting interlock placed on your car, a driver can avoid most of the license suspension on a first offense on alcohol related DWI.
         However, if charged and guilty of being under the influence of even legal prescription drugs while driving, there is a mandatory loss of license for 7 months-12 months. The NJ DWI statute is not only about prohibiting driving after drinking. It also prohibits driving after taking prescription medication, which may render someone under the influence. Even if a medical doctor prescribed the medication police can still charge someone with driving under the influence of those medications.
     It does not matter whether the drugs are legal or illegal for the seven-month suspension. If does not matter if you have a valid medical marijuana card.
           If charged with DWI under influence of a drug, you need to have your attorney immediately file specific motions:

5)  Request for dismissal if all discovery not timely provided.

      The NJ statute on expungement was revised effective June 15.  Nothing is automatically erased yet. If someone has been arrested or even had a private criminal complaint signed against them in the Municipal Court, they have a criminal record, even if the charges were dismissed or received a Conditional Discharge Under NJ Law past criminal arrests and convictions can beged/ erased under certain instances. This program will discuss the expungement process. I served as a Municipal Prosecutor and was amazed how minor criminal guilty pleas and even dismissed charges can affect someone's ability to get a job or advance a career.      This domestic violence case concerns the breadth of "household member" jurisdiction in the context of a modern, blended-family where the parties are adult, half-siblings who shared meaningful, regular parenting time with their common father during their youth - though never resided together. Throughout their youth, the parties regularly and consistently spent substantial periods of time at their common father's home, including the defendant spending overnights every other weekend during the school year and more extended times during the summer at their father's home. Although he did not have a bedroom, he had a fixed sleeping arrangement and drawers containing underwear, gym shorts, and toiletries. During and after college, their in-person contact decreased, but they still gathered informally and at family milestones and vacations. (FV-13-1110-19)

Some people try to avoid getting documents done correct by trying to fill out something online, but then usually never have documents done right or signed correct.

Please print out your Wills & documents single sided and carefully staple and read your documents. The Power of Attorney and Living Will are separate documents, which you must staple separately.

   Most persons are signing at UPS stores, which has notary service, with your own witnesses, or using another notary of their choosing.

Defendant pleaded guilty to two counts of violating N.J.S.A. 2C: 40-26(b) by driving during a period of license suspension or revocation for a second or subsequent violation of N.J.S.A. 39:4-50, driving while under the influence, or N.J.S.A. 39:4-50a, refusal to provide a breath sample. The court sentenced defendant on each count to a 180-day term of imprisonment with a 180-day period of parole ineligibility as a condition of serving a two-year probationary term. The court ordered the custodial terms to be served consecutively and the probationary terms to be served concurrently.
Defendant argued his sentences are illegal because the Criminal Code does not authorize a spilt sentence with a term of imprisonment that includes a mandatory period of parole ineligibility. The court disagreed, finding the plain language of N.J.S.A. 2C: 43-2(b)(2) authorizes sentences including terms of incarceration as a condition of probation, with the only limitation being the term of incarceration may not exceed 364 days. The court finds that because defendant's individual and aggregate custodial sentences require less than 364 days of imprisonment as a condition of probation, they are authorized by N.J.S.A. 2C: 43-2(b)(2) even though the terms of imprisonment include mandatory periods of parole ineligibility.
The court also determined the sentencing court erred by failing to make findings supporting its imposition of consecutive sentences, see State v. Yarbrough, 100 N.J. 627 (1985), and by imposing sentences that were both consecutive and concurrent, see State v. Rogers, 124 N.J. 113 (1991). The court remanded for resentencing. A-4473-18T3)
3. Crime spree exception to expungement approved here.State v A.R. 
This case presents the question of whether petitioner A.R.'s convictions fall within the "crime-spree" exception contained within N.J.S.A. 2C: 52-2(a), making them eligible for expungement. Specifically, the granting or denying of petitioner's expungement petition turns on the phrase: "crimes [which are] interdependent or closely related in circumstances and were committed as part of a sequence of events that took place within a comparatively short period of time." N.J.S.A. 2C: 52-2(a). Petitioner and the State concede that this phrase is undefined in the statute, yet offer competing interpretations. The State proposes a strict interpretation of this language, whereas petitioner asserts that the expungement statute - as remedial legislation - should be liberally interpreted. This court concludes that a liberal interpretation of this language is consistent with the general purpose of the expungement statute. Petitioner's convictions are "closely related in circumstances" because they stem from two instances where he engaged in the unlawful sale of narcotics to a "friend" and an undercover officer, and were committed over a period of six weeks, which is a "comparatively short period of time." Therefore, petitioner's convictions are eligible for expungement pursuant to N.J.S.A. 2C:52-2(a). (00-09-1483/01-02-0229)

 The plan is scheduled to start incrementally on Monday, June 22, 2020.
         In Phase 2, most Municipal Court proceedings will continue to be handled remotely, including but not limited to: 
  • Disorderly persons / petty disorderly persons offenses, traffic, DWI dispositions, parking, local ordinance, penalty enforcement and other hearings; First Appearance/CJP; violations of monitoring and probation; bench trials, sentencing hearings, evidentiary hearings, and testimonial motions with consent; guilty pleas; post-adjudication and non-compliance hearings; and dismissals [page 25 of Order]
        As courts transition to Phase 2, the following Municipal Court matters may, consistent with Supreme Court guidance, be handled in person:

Preparation of draft Will and Testament with Provisions regarding debts and taxes, distribution of estate, Trust for beneficiaries under 21, provisions for primary Executor and one successor Executor, include provisions regarding no bond required and self- proving Will meaning your family will not need to locate witnesses later.  
10. Prepare letter to client enclosing draft of Will for client to carefully read.
11. Preparation of Post Will Instruction letter to client 
12  Provide bi-weekly email newsletter with updates on Probate, and NJ legal issues.

Please print out your documents single sided and carefully staple documents. The Power of Attorney and Living Will are separate documents, which you must staple separately. Please read these documents carefully.
         On day of signing, bring:
-Documents stapled separately
-Your pen
-Your mask
         Park in parking lot, then call the office.
         Otherwise, sign documents at UPS store, which has notary service, with your own witnesses, or use another notary of your choosing.
